I seem to be hanging out in Courtroom Confusion these days - Can anyone help me with information about the process of appointing an attorney to a defendant who cannot afford one.  Such as who does the appointing, and are there any considerations concerning the appointment - such as the specific charge, or is it just the next attorney up?

Sorry to be so vague, but poking around on this has left me with no information on how this system works when it gets down to putting together attorney and defendant.

who does the appointing

In our area,  they first have to apply to the public defender's office and show that they qualify.  By qualifying they must show that they are indigent and unable to pay for a private attorney.

are there any considerations concerning the appointment such as the specific charge, or is it just the next attorney up?

Tehcnically it's the next one up, but in real life, they will appoint an attorney best capable of mounting a credible defense.
